Passed Out In Ditch Behind Wheel Leads To Impaired Charge For Suspended Driver

(TOWNSHIP OF GUELPH-ERAMOSA, ON) – On January 15, 2021, at approximately 3:00 a.m. the Wellington County Ontario Provincial Police (OPP) responded to a report of a single motor vehicle collision on Fifth Line in the Township of Guelph-Eramosa.

Upon arrival, police located a vehicle in the ditch with the engine running.  The driver was observed to be sleeping behind the wheel.

Police spoke with the driver and determined that their ability to operate a motor vehicle was impaired by alcohol. The driver was placed under arrest and underwent further testing.

Michael Ivor NUNES, 53-years-old of Mississauga, has been charged with Operation While Impaired – 80 Plus, Operation While Impaired -alcohol or drug contrary to the Criminal Code, and two counts of Driving While Suspended contrary to the Highway Traffic Act.

A 90-day Administrative Driver’s Licence Suspension (A.D.L.S.) and 7-day Vehicle Impoundment was initiated as per statute. The accused is scheduled to appear in the Ontario court of justice – Guelph on February 5, 2021 to answer to the charges.

If you suspect someone is driving while their ability to operate a motor vehicle is impaired, either by drug or alcohol, call police at 911 to report it.
