WINGHAM, North Huron – The fallout from the controversial February 17 incident outside a North Huron council meeting has now moved into Superior Court.
George Brent Mills and his wife, Nancy Mills, have filed a multi-million dollar Statement of Claim against Deputy Reeve Kevin Falconer and The Corporation of the Township of North Huron.
The claim was issued by the Ontario Superior Court of Justice in Goderich on September 16, 2026, under court file CV-26-0000108-0000. North Huron has now been served with the lawsuit.
The allegations have not been proven in court, and the defendants will have an opportunity to respond. In an Ontario civil action, the plaintiffs ultimately bear the burden of proving their allegations on a balance of probabilities. Ontario Courts
Mills Alleges Deputy Reeve Grabbed His Testicles
The lawsuit arises from the events immediately following the February 17 North Huron council meeting.
According to the Statement of Claim, Falconer remained on municipal property following the meeting and was answering questions from members of the public and media concerning North Huron business.
The claim alleges that after Free Press co-founder Brad Carther questioned Falconer about the return of public and media questions at council meetings, Falconer became involved in a confrontation with Stephen Hill.
Mills alleges he stepped between Falconer and Hill as Falconer advanced toward Hill.
The lawsuit alleges Falconer then intentionally grabbed, held and squeezed Mills’s testicles without his consent.
Mills characterizes the alleged conduct in his lawsuit as assault, battery and sexual assault.
The claim further alleges that Mills continues to suffer physical pain, nightmares and sleepless nights, along with humiliation and emotional distress.
North Huron Sued Too
The lawsuit doesn’t stop with Falconer.
Mills alleges North Huron should also bear responsibility because the incident occurred on municipal property immediately following a council meeting while Falconer, as Deputy Reeve, was still engaging with the public and media about municipal business.
The pleading also points to the fact that North Huron had hired a security guard for the meeting that night, yet Mills alleges the assault nevertheless occurred.
The plaintiffs advance a claim of vicarious liability against North Huron and also plead misfeasance in public office against Falconer.
Nancy Mills has joined the lawsuit with a claim under Ontario’s Family Law Act for losses she alleges resulted from the effects of her husband’s injuries.
The lawsuit seeks more than $5 million in damages, including general, aggravated, punitive and exemplary damages, Nancy Mills’s derivative damages, special damages, interest and costs.
A Statement of Claim sets out allegations and the relief sought; filing it does not establish that the allegations are true or that the damages claimed will ultimately be awarded. Now North Huron Has to Answer
North Huron has now been formally served.
After service of a Superior Court Statement of Claim, a defendant must respond in accordance with the Rules of Civil Procedure; the defendant can also use a Notice of Intent to Defend to obtain additional time to deliver its defence. Ontario Courts
