Eye Makeup Leads to Careless Driving Charge

(CENTRAL HURON, ON) Shortly before 9:00 am on February 3, 2010 a female driver was witnessed on London Road near Clinton to be applying eye makeup while driving. An officer was patrolling in the area when he witnessed the infraction. The female was stopped and as a result of the investigation, Elizabeth PECK (22) of Huron East was charged with one count of Careless Driving.

Although the Distracted Driving legislation speaks to the use of hand-held devices while driving, officers have always had the discretion to lay a charge of Careless Driving where the circumstances dictated that was appropriate. Careless Driving speaks to driving “without due care and attention”. Motorists need to remember that driving is an active job that requires full attention. Although we multitask in many other areas of our lives, while driving is NOT the time.
